Terms of Service

These terms govern your use of Smoke Theory, a platform operated by Stealth Grp LLC (“Smoke Theory,” “we,” “us”), and any brand program you join through it, such as the Blueprint Redline Program. By creating an account or using the service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

1. Eligibility

• You must be at least 21 years old.
• You must be employed by, or otherwise authorized to represent, a licensed cannabis retailer or the brand running the program, and you must be truthful about your store and role.
• Brand programs may require a join code and approval by the brand. Membership is at the brand’s discretion and may be declined or revoked at any time.
• You may only hold one account, and you may not share it.

2. What the service is (and is not)

Smoke Theory is a feedback and rewards tool. It is not a marketplace. Nothing on the platform is an offer to sell, purchase, or transfer cannabis or cannabis products, and no cannabis is sold, ordered, or delivered through it. Any samples, product, or rewards are provided by the brand, off-platform, in compliance with applicable state law and the brand’s own policies.

3. Brand programs and rewards

• Each brand sets its own program rules, tiers, and rewards. The brand, not Smoke Theory, is responsible for fulfilling them.
• Rewards have no cash value, are not wages or compensation, and may be changed or discontinued by the brand at any time.
• Leaderboards and rankings are based on program activity as recorded in the platform; the brand’s determinations are final.
• You are responsible for following your employer’s policies and any state rules regarding gifts, samples, or incentives from brands. If your employer or state prohibits participation, do not participate.

4. Your content

You own the reviews, ratings, and other content you submit. You grant Smoke Theory and the brand whose program you joined a worldwide, royalty-free license to store, display, analyze, and use that content to operate the program and to understand product demand, including in aggregated or de-identified form. You agree your content will be accurate, based on your own experience, and free of anything unlawful, defamatory, or infringing.

5. Acceptable use

You agree not to:

• submit false reviews, manipulate rankings, or create multiple accounts;
• use the service to market or sell cannabis to consumers, or to make medical claims;
• scrape, reverse engineer, or interfere with the service or other users’ accounts;
• upload malicious code or attempt to access data that is not yours.

6. Accounts and termination

You are responsible for keeping your password secure and for activity under your account. You may close your account at any time. We or the brand may suspend or terminate your access if you violate these terms, if the program ends, or if we reasonably believe it is necessary to protect the service or comply with law.

7. Privacy

Our Privacy Policy explains what we collect and how it is shared with the brand. Using the service means you accept it.

8. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, Smoke Theory disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or that any brand will fulfill rewards.

9. Limitation of liability

To the fullest extent permitted by law, Stealth Grp LLC and Smoke Theory will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service will not exceed one hundred U.S. dollars ($100).

10. Indemnity

You agree to defend and hold harmless Stealth Grp LLC, Smoke Theory, and participating brands from claims arising out of your content, your breach of these terms, or your violation of any law or employer policy.

11. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction. Nothing in these terms limits any rights you have under applicable consumer protection law.

12. Changes

We may update these terms from time to time. The current version will always be posted here with its effective date. Continued use after a change means you accept the updated terms.
